Refusal to Supply Sample of Breath


On March 9, 2017, at approximately 2:20 am, a Sarnia Police Constable on patrol observed a pickup truck travelling at a high rate of speed westbound on London Road and then notes the vehicle to turn and head northbound onto Murphy Road. The truck was then observed travelling through a red stop light without stopping. The officer then activated his emergency lights and conducted a traffic stop to speak with the driver.

As the officer spoke with the driver grounds were formed to demand that the driver supply a sample of breath into a road side screening device. At this time the driver refused to supply a sample of breath and was subsequently arrested.

The 28 year old driver from Sarnia was released with an Appearance Notice for court and is now facing the charge of refusing to provide a sample.
