As the officer began speaking to the driver and investigating the situation further a demand was made for the driver to supply a sample of breath into a road side screening device. The test indicated a fail and the driver was arrested. The accused was then transported to the station where testing continued on the Intoxilyzer by a qualified Breath Technician. This test again confirmed that the accused was over 80 mg of alcohol per 100 ml of blood.

While the officers were by their cruisers a vehicle began drifting towards them. The officers were able to get back into their vehicles and catch up to the motor vehicle that caused the incident. A traffic stop was conducted and ultimately a road side alcohol screening device test was administered to the driver. Results indicated a fail and the accused was taken into custody and transported back to the Sarnia Police Station. There a qualified Breath Technician conducted testing on an Intoxilyzer which indicated the suspect was over twice the legal limit of 80 mg of alcohol per 100 ml of blood.
